This Privacy Notice for California Residents supplements the information contained in AIIR Consulting, LLC’s Privacy and Data Usage Policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). AIIR Consulting, LLC and its sister company AIIR Analytics, LLC (collectively, “Company” or “we”) adopt this notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA”), and any terms defined in the CCPA have the same meaning when used in this notice.
Our AIIR Sites collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“personal information”). In particular, the Company’s website at https://aiirconsulting.com, the Coaching Zone platform available at https://coachingzone.com, the AIIR Analytics website at https://aiiranalytics.com, the AIIR Analytics application at https://app.aiiranalytics.com, and any other associated software applications (collectively, the “AIIR Sites”) has collected the following categories of personal information from its consumers within the last twelve (12) months:

The Company uses artificial intelligence (“AI”) and machine learning technologies in connection with the AIIR Sites and the services we provide, including AI-assisted coaching features within the Coaching Zone platform, assessment analysis, and service improvement. When AI is used to process your personal information, the safeguards described in our Privacy Policy apply, including human review of AI-generated outputs that inform material decisions and restrictions on the use of your personal data for third-party AI model training without your explicit consent. Company may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. This includes third-party AI service providers who process data on our behalf.

You have the right to request that Company correct inaccurate personal information that we maintain about you, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will use commercially reasonable efforts to correct the inaccurate personal information.
To the extent Company processes sensitive personal information (such as account log-in credentials) for purposes beyond those authorized under the CCPA, you have the right to request that we limit our use of your sensitive personal information to only those uses that are necessary to perform the services or provide the goods you have requested, or as otherwise authorized by law. Currently, the Company does not use or disclose sensitive personal information for purposes that would require offering this right of limitation under the CCPA.
You have the right to direct us to not sell or share your personal information at any time (the “right to opt-out”). The Company does not currently sell or share personal information as those terms are defined under the CCPA. If this practice changes in the future, we will update this notice and provide you with an opt-out mechanism.
We do not sell or share the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password-protected account sufficiently verified when the request relates to personal information associated with that specific account.
We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

When we make changes to this privacy notice, we will post the updated notice on the AIIR Sites and update the notice’s effective date. Your continued use of our AIIR Sites following the posting of changes constitutes your acceptance of such changes.
